Terms of use

These terms are the agreement between you and Bufufu OÜ, the company that makes SitNudge (“we”, “us”). They apply when you use SitNudge at sitnudge.com, try it, buy a plan, or give or open a gift. By using SitNudge you agree to them. How we handle personal data is explained in our privacy policy.

1. What SitNudge is

SitNudge is a web app that runs in your browser. With your permission it uses your webcam to estimate how your head is positioned compared with the good posture you showed it at the start, and it nudges you when you slouch for longer than you chose. The camera image is analysed on your own computer and is never uploaded or saved.

To use it you need a computer with a webcam and an up-to-date browser that supports it (currently Chrome, Edge or Safari). Please use the free trial to check that it works well on your setup before you buy.

2. It's not medical advice

SitNudge is a general wellbeing tool that reminds you about your posture. It is not a medical device and does not diagnose, treat, cure or prevent any condition. Its readings are estimates from a camera image and can be wrong. It doesn't replace advice from a doctor, physiotherapist or other health professional. If you have pain or a health condition, please talk to one of them before changing how you sit, and stop if anything hurts.

3. The free trial

Each browser gets 20 minutes of active use for free, without payment details or sign-up. The minutes only count while SitNudge is switched on and you're at your desk. The trial is meant once per person, so please don't reset it to avoid paying. We may change the length of the trial for new users at any time.

4. Plans and paying

Plans

We offer a monthly plan, a yearly plan and a lifetime plan. Current prices are shown on sitnudge.com and at checkout before you pay. They include VAT or sales tax where it applies, and checkout may show them in your local currency.

Who handles your payment

Payments are processed by Stripe through its Link service, which acts as the reseller and merchant of record for your purchase. That means Link takes the payment, works out and pays the tax, sends your receipts and invoices, and appears on your bank statement (as “LINK.COM* SitNudge” or similar). Link's own terms apply to the payment itself, and these terms apply to your use of SitNudge. We never see your full card details.

Subscriptions

Monthly and yearly plans renew automatically at the end of each period and are charged to the same payment method until you cancel. You can cancel any time under Manage next to your plan in SitNudge, or through Link. When you cancel, you keep SitNudge until the end of the period you've already paid for and you won't be charged again. Apart from the refunds in section 7, we don't refund the unused part of a period.

If we change the price of a subscription, we'll email you at least 30 days before the new price applies to your next renewal, so you can cancel before then if you prefer.

Lifetime

The lifetime plan is a single payment with nothing to renew. “Lifetime” means for as long as we offer SitNudge, not the lifetime of a person. We intend to keep SitNudge running for a long time. If we ever decide to close it, we'll tell lifetime customers by email at least 90 days in advance.

Launch prices and promotion codes

From time to time we may offer a launch price or a promotion code. Each offer is valid until the date shown with it and can't be combined with other offers unless we say so. When it ends, the regular price applies to new purchases. Anything you've already bought is unaffected.

5. Your licence

When you pay, we give you a personal, non-transferable right to use SitNudge for as long as your plan lasts. You can use it on all of the computers and browsers you use yourself, and your email is the key that unlocks it on each one. Please don't share your access with other people or resell it. If you want to give it to someone, that's what gifts are for.

When you use SitNudge, please don't:

• get around the trial, the licence check or the payment, or help others to do so;
• overload or attack our servers, or use automated scripts to call them;
• copy, resell or pass off SitNudge, its design or its content as your own;
• use it in a way that breaks the law or harms other people.

SitNudge, its name, design and content belong to Bufufu OÜ. Some open-source parts, such as Google's MediaPipe, come with their own licences, and nothing in these terms limits your rights under those licences.

6. Gifts

• A gift is paid for once by the giver and never renews. It's either a year of SitNudge or SitNudge for life.
• The gift code doesn't expire until it is opened. A gifted year starts the moment the recipient opens it, not when it was bought.
• The first email address used to open a code owns the gift, and the same code and email unlock it on the recipient's other computers. Treat the code like a gift card: anyone who has it can open it.
• Gifts can't be exchanged for cash. If the payment for a gift is refunded or reversed, the gift stops working.
• You're responsible for the names and message you write on the card. Please keep them lawful and kind, since anyone with the code can read them.

7. Refunds and your right to withdraw

14-day money-back promise. If SitNudge isn't right for you, email us within 14 days and we'll refund you in full. You don't have to give a reason. This covers:

• any new monthly, yearly or lifetime purchase, within 14 days of paying;
• a yearly renewal, within 14 days of the renewal payment;
• a gift, within 14 days of buying it, as long as the code hasn't been opened yet.

To ask for a refund, write to hello@sitnudge.com from the email address you paid with, or contact Link support. When a payment is refunded, the plan or gift it paid for ends. Outside these cases we'll still listen and decide fairly, case by case.

If you live in the EU, the EEA or the UK, the law gives consumers a 14-day right to withdraw from an online purchase. Our promise above is at least as generous, so you can use it without any form or explanation. None of this limits your other legal rights as a consumer, including your rights if SitNudge doesn't work as described.

8. Changes to SitNudge and availability

We keep improving SitNudge, so features and how it looks will change over time. If a change makes SitNudge materially worse for you during a period you've paid for, tell us and you can end your plan and get a refund for the unused part.

We work hard to keep SitNudge available, but we can't promise it will always run without interruption or errors, or on every device, browser or camera. Some parts depend on services we don't control, such as your browser, Stripe and our hosting provider.

9. Responsibility and liability

We are responsible for providing SitNudge as described, with reasonable care and skill. We aren't responsible for losses we couldn't reasonably have foreseen, for losses caused by events outside our reasonable control, or for business losses (SitNudge is for personal use).

Where the law allows, our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law, such as liability for intentional wrongdoing, gross negligence, fraud, or death or personal injury caused by negligence, and nothing affects the rights you have as a consumer by law.

10. Ending the agreement

You can stop using SitNudge at any time, and cancel your subscription as described above. We may suspend or end access for someone who seriously or repeatedly breaks these terms, for example by getting around the payment or abusing our servers. Where reasonable, we'll warn you first. If we end your access without it being your fault, we'll refund the unused part of what you paid.

11. Changes to these terms

We may update these terms, for example when we add features or the law changes. The date at the top shows the latest version. If a change matters for paying customers, we'll email you at least 30 days before it applies to you. If you don't agree, you can cancel before then. Changes never apply to a period you've already paid for in a way that's worse for you.

12. Law and disputes

These terms are governed by the laws of Estonia. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in the courts there.

If something goes wrong, please contact us first. Most things can be sorted out quickly by email. Consumers can also turn to the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon) at the Consumer Protection and Technical Regulatory Authority, or to the consumer body where they live.
